If you believe that an image, audio or video recording displayed or used in any way on the Website constitutes copyright or trademark infringement, please report the offending media by emailing us (see below), giving a brief description of your concerns and your contact details. Please make sure that you include the offending url and your full contact details.
All watermarked images generated by software applications at picture.tools are copyrighted by Orpheus Media and cannot be used commercially without our express permission. Paying subscribers hold the copyright for unwatermarked images generated using our software applications, and can use these images commercially.
CHANGES TO TERMS & CONDITIONS
Picture.tools will make every effort to ensure that the Website is available continuously, but reserves the right to modify, suspend or discontinue all or any part at any time with or without notice. Unless specifically exempted, any new features, services or software applications introduced shall be subject to these Terms and Conditions. Picture.tools reserves the right to modify or replace these Terms and Conditions at any time. Any change shall be effective immediately as it appears on the site. Each time you use the Website you are deemed to have accepted any such change.
FAILURE TO COMPLY
In the event that you commit a breach of these Terms and Conditions picture.tools reserves the right at its sole discretion to immediately and without notice suspend or permanently deny your access to all or part of the Website, and to delete your account and all media and content associated with it. By breaching these Terms and Conditions you surrender all rights to a refund of any subscription fees you have paid to picture.tools.
TERMINATION
You may discontinue use of the Website at any time. These Terms and Conditions will continue to apply to past use by you.
LIMITATION OF LIABILITY
In no circumstances will picture.tools or its owners be liable for any loss or damages, whether direct or consequential arising out of (i) your use of the Website or your inability to do so (ii) your reliance on any content and/or (iii) goods and services in any way associated with the Website.

The following conditions are applicable to the Website visitors in addition to the General Terms and Conditions above:
PAYMENTS
Picture.tools collects monthly subscription payments from subscribers who have opted for our paid services. We make every effort to make our billing system as fair and transparent as possible. Please note the following important points regarding subscription payments at picture.tools:
- Subscribers are billed on a monthly basis until they choose to cancel their subscription.
- You can cancel your subscription at any time by logging into your account, navigating to 'My Account', then to 'Manage Subscription'. From here, follow the simple steps to confirm cancellation. Alternatively you can cancel by contacting us via our Contact Form.
- You are entitled to a refund on subscription purchases within 14 days of purchase ONLY in the case that you have not used any of of the montly credits applied to your account since your most recent purchase. In the case that any credits have been used, the purchase is completely non-refundable.
- Payments are processed and handled by Stripe.
EMAIL COMMUNICATIONS AND ANTI-SPAM POLICY
We never share your email address with any third party. We never spam. As a user of picture.tools, you will only ever receive emails directly from our web server.
You will only be emailed under the following circumstances:
- If you request an email by performing a specific type of action on picture.tools.
- If you contact us.
- If a change to your account or subscription status occurs or is imminent, and we need to send a reminder or alert.
- If there are significant new services or features being introduced at picture.tools.
If you decide to deactivate your account, then you will receive no more communications from picture.tools or its administrators.

Important Note: Deactivating your account does not cancel your monthly payment subscription if you have purchased one. To cancel your monthly payment you must go to the subscription management page.
PRIVACY
When you view our Website we do not collect any personal information that could identify you. Our server collects generic information about your pathway through our site and assigns it to your IP address. This information is used to analyse general patterns of Website use. We do not identify individuals using this information.
If you complete an online feedback form or contact us via email we might ask that you provide your name and email address. This information is held in a database. We will only use this address to provide feedback on your specific enquiry.
RESPONSIBILITY OF USERS
All users of picture.tools are obliged to abide by these terms and conditions. Accounts may be suspended or deleted for any inappropriate use including but not limited to the following:
- Attempting to use our software in any means other than via a standard web browser, e.g. automation using a bot etc.
- Entering any prompt into the image generation tools which contains obscene or offensive language.
- Uploading any image which contains nudity, obscenity or illegal content.
- Attempting to generate or edit any image which contains nudity, obscenity, illegal or offensive content.
